§ 1. Definitions

  1. Regulation - this Regulation of the Online Store.
  2. Customer - a natural person, legal person, or organizational unit not being a legal person, to which the law grants legal capacity, conducting business or professional activity in their own name and performing a legal act directly related to their business or professional activity.

  4. Seller's, Service Provider's address:

  5. Online Store - the online service operated by the Seller, available at the electronic address: https://strefab2b.chomik.pl, through which the Customer can obtain information about the Goods and their availability and purchase the Goods.
  6. Order – the Customer's declaration of intent, directly aimed at concluding a Distance Sales Agreement via the Online Store.
  7. Sales Agreement - a sales agreement concluded at a distance, under the terms set out in this Regulation, between the Customer and the Seller, through the Online Store.
  8. Goods - movable items that the Customer can purchase in the Online Store.
  9. Business Day – a day of the week from Monday to Friday, excluding public holidays.
  10. Privacy and Cookies Policy of the Online Store - a document specifying the detailed principles of processing personal data and the use of cookies. The Privacy and Cookies Policy is available at https://strefab2b.chomik.pl/en/privacy-and-cookie-notice.html.
  11. Registration Form – a form available in the Online Store enabling the creation of an Account.
  12. Order Form - the electronic procedure provided by the Seller for the Buyer to place an order.
  13. Account – an individual panel for each Customer, set up by the Service Provider for the Customer after the Customer registers and enters into an agreement for the provision of services.

§ 2. General Provisions

  1. This Regulation sets the rules for the functioning of the Online Store and is intended exclusively for entrepreneurs, i.e. natural persons, legal persons, or organizational units not being legal persons, which the law grants legal capacity, conducting business or professional activity in their own name and performing a legal act directly related to their business or professional activity.
  2. The Seller, through the Online Store, only conducts wholesale sales to Customers.
  3. The use of services of the Online Store means acceptance of this Regulation.
  4. The Seller reserves the right to modify the technical implementation of the functionality of the Online Store, in accordance with the scope and conditions resulting from the Seller's powers, as well as according to the available technical capabilities.
  5. The use of the Online Store is possible provided that the IT system used by the Customer meets the following minimum technical requirements:
    1. Internet browsers in the current version, e.g.:
      • Firefox
      • Chrome
      • Microsoft Edge
    2. Any program for viewing PDF files.
  6. The content posted on the Online Store's pages, including descriptions of Goods and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  7. The Seller provides this Regulation along with the Annexes through a link posted on the main page before the conclusion of the Distance Sales Agreement, during its execution, and after its completion. The Buyer can download it and make a printout.
  8. In order to ensure the security of communication and data transmission related to the services provided, the Online Store takes technical and organizational measures appropriate to the level of security of the services provided, especially measures to prevent the acquisition and modification of personal data transmitted over the Internet by unauthorized persons.

§ 3. Orders

  1. An order in the Online Store is placed via the Account.
  2. An Order can be placed after accepting the Regulation and the Privacy Policy.
  3. The Order is placed by filling out the Order Form available on the Online Store's pages. The selection of the Goods to be ordered is made by adding them to the cart. The Order Form specifies, among other things, which Goods, at what price, and in what quantities the Customer wishes to order. The Customer takes the appropriate technical steps based on the displayed messages.
  4. After providing all the necessary details, the Customer will see a summary of the submitted order. The order summary will include information about: the Seller’s identifying details, the subject of the order, the unit and total price of the ordered Goods.
  5. To be accepted, the Order must have a minimum value of 3000 PLN net.
  6. The Customer will be informed by an email message sent to the contact address of the Account about the acceptance of the Order and the conclusion of the Sales Agreement.
  7. The Order will be processed, subject to the availability of Goods. In case of unavailability of the Goods, the Customer will be immediately informed about the waiting time for the Order to be processed, with a request to confirm the intention to continue its processing or cancel the Order due to permanent unavailability of the Goods.

§ 4. Payment

  1. The Online Store offers the possibility of making payments in the form of prepayments, cash on delivery (payment to the account after delivery). The option of payment with a deferred payment term is available in situations individually agreed with the Seller.
  2. Payment for the goods can be made in the manner selected at the time of placing the order on the Electronic Order Form.
  3. The currently available payment methods in the form of prepayments in the Online Store are available at https://strefab2b.chomik.pl/en/payments.html.

§ 5. Delivery

  1. In the Order Form, the Customer selects the method of delivery by marking the chosen option.
  2. Delivery of ordered Goods within Poland is carried out by the Seller’s transport or courier service. The delivery costs within Poland are 0 PLN for orders above 6000 PLN net.
  3. Delivery of ordered Goods outside the territory of the Republic of Poland is possible upon individual arrangement.
  4. The total delivery costs will be indicated after the Order is placed in the proforma sent by our employee.

§ 6. Withdrawal from the Agreement

  1. The Customer has no right to withdraw from the Sales Agreement.

§ 7. Complaints

  1. A complaint due to a defect in the Goods or non-compliance of the Goods with the concluded Distance Sales Agreement should be submitted via email to reklamacje.megahurt@chomik.pl
  2. The Seller is liable under the warranty if the physical defect is found before the expiration of a maximum of one year from the sale of the Goods to the Customer.
  3. Shortages and damages in delivery should be reported within 4 days of receiving the Goods by the Customer.
  4. The complaint should include the invoice number related to the order, specify the defect that, in the Customer's opinion, the Goods have, the claims against the Seller, and if possible – document the defect with photographs, video, and/or description.
  5. The Seller is obliged to respond to the complaint within 14 days from the day of its receipt. If no response is provided within the specified period, the complaint is considered accepted. The Seller will send the response to the complaint to the Customer in writing or by email to the address from which the complaint was submitted.
  6. In case the complaint is considered justified by the Seller: the costs of replacement, repair, including the cost of shipping related to the complaint of the Goods, will be borne by the Seller.
  7. The transport of the complained Goods under the warranty is at the expense of the Seller and will be carried out by the courier company selected by the Seller, unless the Seller informs that the Goods will be collected by the Seller or a person authorized by them. The Seller does not accept parcels sent by cash on delivery. The address for sending the complained packages is: Gdów, ul. Przemysłowa 10, 32-420 Gdów.
  8. The Seller is obliged to deliver Goods free from defects and is liable to the Entrepreneur for defects in the purchased Goods under the rules defined in the Civil Code.

§ 8. Final Provisions

  1. These Terms and Conditions are valid from 2025.03.17.
  2. In case of changes or invalidation of any provision of this Regulation by the decision of the competent authority or court, the remaining provisions remain in force and bind both the Seller and the Customer.
  3. The Seller reserves the right to change this regulation. All contracts concluded before the entry into force of the new regulation will be executed based on the regulation that was in force at the time of concluding the contract.
  4. The law applicable for resolving all disputes related to this Regulation is Polish law. These disputes will be resolved by the court competent for the Seller's registered office. At the same time, we inform you that these proceedings are voluntary, and both parties must express their consent to them.
